29 CFR 1910.120(f)(3)(ii)(A): Medical examinations and consultations were not made available by the employer to employees covered under 29 CFR 1910.120(a)(1)(v) who could have been injured, received a health impairment, developed signs or symptoms which may have resulted from exposure to hazardous substances resulting form an emergency incident, or exposed during an emergency incident to hazardous substances at concentrations above the permissible exposure limits or the published exposure levels without the necessary personal protective equipment being used as soon as possible following the emergency incident or development of signs or symptoms:   El Dorado National Forest:  On Thursday, August 2, 2018, Law Enforcement Officers were exposed to waste contaminated with chemicals such as carbofuran while conducting eradication and reclamation activities in a marijuana grow operation.  Employees developed a range of symptoms over the next few days and medical attention was not provided and made readily available until the following Monday, August 6, 2018.

29 CFR 1910.120(f)(6): The employer did not provide a copy of 29 CFR 1910.120 and its appendices to the attending physician and did not provide the information required by 29 CFR 1910.120(f)(6)(i) through (f)(6)(v):  El Dorado National Forest:  Information concerning employee exposure to hazardous waste was not provided to employees after an exposure incident.  On August 2, 2018, Law Enforcement Officers were exposed to waste contaminated with chemicals such as carbofuran while conducting a marijuana eradication operation and developed a range of symptoms over the next few days.

29 CFR 1910.120(k)(2)(iii): All employees leaving a contaminated area were not appropriately decontaminated and all contaminated clothing and/or equipment leaving a contaminated area was not appropriately disposed of or decontaminated:   El Dorado National Forest: Law Enforcement Officers who conducted eradication and reclaiming operations within marijuana grow sites where hazardous waste was continually encountered were not adequately decontaminating themselves or disposing of their attire/personal protective equipment.

29 CFR 1910.120(b)(1)(i): Employers shall develop and implement a written safety and health program for their employees involved in hazardous waste operations. The program shall be designed to identify, evaluate, and control safety and health hazards, and provide for emergency response for hazardous waste operations.   El Dorado National Forest:  The elements of the hazardous waste operation program that included a comprehensive work plan; a site-specific safety and health plan; the safety and health training program; the medical surveillance program; and the employer's standard operating procedures for safety and health were not implemented where employees encountered toxic hazardous waste.   The U.S. Department of Agriculture - Forest Service - Region 5 was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1092933, citation number 01, item number 001 and was affirmed as a final order on 12/08/2016, with respect to a workplace located at 1323 Club Drive, Vallejo, CA 94592.
