29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)    (a) Hershey Towne Square, 169 West Chocolate Avenue, Hershey, Pennsylvania - Employees cut concrete with a Stihl TS 500i hand-held power saw, exposing them to respirable crystalline silica, which can cause silicosis, and the employer did not provide exposed employees with effective information and training, including on the hazards of the chemical and proper methods to control exposure, on or about August 15, 2018.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assessed and limited the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:    (a) Dumpster Pad behind Starbucks - Employees used a Stihl TS 500i hand-held power saw to cut the concrete pad.  The employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for hand-held power saws on Table 1 in that while one employee operated the saw to cut the concrete a second employee used a portable plastic water sprayer to manually spray water on the sawing operation rather using the saw's integrated water delivery system to continuously feed water to the saw blade as required by Table 1, exposing the employees to potential over exposure to respirable crystalline silica, on or about August 15, 2018.    Corrected during the inspection.  No abatement certification or documentation required.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:    (a) Dumpster Pad behind Starbucks - To cut the concrete pad, employees used a Stihl TS 500i hand-held power saw without using an integrated water delivery system to continuously feed water to the blade as required by Table 1, and the employer did not assess the silica exposure of each employee in accordance with either the performance option or the scheduled monitoring option, exposing the employees to potential over exposure to respirable crystalline silica, on or about August 15, 2018.    Corrected during the inspection.  No abatement certification or documentation required.
