29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: (Note: When employees are using stilts, the top edge height of the top rail, or equivalent member, shall be increased an amount equal to the height of the stilts.) (a) Building 1 Roof - An employee worked from the flat roof to fish wiring for a roof-top HVAC unit. The roof had a parapet wall with a height of 25 inches along the rear east side of the building, which did not meet the minimum top edge height requirement of 39 inches for a guardrail system, exposing the employee to the hazard of falling to a lower level, on or about August 15, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.
