29 CFR 1926.1153(c)(1): The employer did not implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, for each employee engaged in a task identified on Table 1, and the employer did not assess and limit the exposure of employees to respirable crystalline silica in accordance with paragraph (d) of this section: a) Route 33, Scajaquada from Delevan to Florida, Buffalo, NY - On or about 08/15/2018, a laborer was operating a rotary hammer drill outside to drill concrete holes. The drill was not equipped with a shroud or cowling with a dust collection system as specified for the task on Table 1 and the employer did not assess and limit the exposure of employees to respirable crystalline silica in accordance with paragraph (d) of this section. ABATEMENT CERTIFICATION REQUIRED
