29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:  a. On or about August 16, 2017, at the above addressed jobsite, employees performing roofing operations were using a ladder jack scaffold as a access point to the roof, approximately sixteen (16) feet above the ground, and were not protected from falls, thereby exposing the employees to fall hazards.

On or about August 16, 2018, at the above addressed jobsite, employees performing residential roofing operations on a roof seventeen (17) feet seven (7) inches above the ground were not protected from falls, thereby exposing employees to fall hazards.

29 CFR 1926.1053(b)(9): The area around the top and bottom of ladders was not kept clear:  a.  On or about August 16, 2018, at the above addressed jobsite, employees were exposed to slip, trip and fall hazards when the bottom of the ladder was not kept clear of debris, including but not limited to, piles of discarded shingles and nails.  Additionally, the ladder that was used to access the ladder was the material hoisting ladder, with a elevator that sat at the bottom of the ladder approximately two (2) feet six (6) inches from the ground.
