29 CFR 1926.152(f)(3): Flammable liquids were used where there were open flames or other sources of ignition within 50 feet of the operation: Note:  Certain conditions warrant that flammable liquids be used farther than 50 feet from open flames or other sources of ignition.  a) Site - On or about 08/17/18 and at times prior thereto roof workers applied flammable solvent-based adhesives in an area of the roof, while a torch flame was set in another area of the roof.  No precautions were taken to eliminate or control the sources of ignition.   Or in the alternative:  29 CFR 1926.152(i)(6): In locations where flammable vapors could have been present, precautions were not taken to prevent ignition by eliminating or controlling sources of ignition:  a) Site - On or about 08/17/18 and at times prior thereto roof workers applied flammable solvent-based adhesives in an area of the roof, while a torch flame was set in another area of the roof.  No precautions were taken to eliminate or control the sources of ignition.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59).  a) Site - On or about 08/17/18 and at times prior thereto employees came in contact with chemicals including (but not limited to flammable solvent-based adhesives. The employer did not develop and implement a written Hazard Communication Pogram.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

The employer did not implement a written Hazard Communication Program and did not collect safety data sheets for the chemicals in use at the worksite. 29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)  a) Site - On or about 08/17/18 and at times prior thereto employees came in contact with chemicals including (but not limited to flammable solvent-based adhesives. The employer did not train the workers in relation to the program, and the Right to Know.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
