29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:    (a)MMI, LLC at 825 Eglin Street, Rapid City, SD 57003: On or about and at times prior to August 16, 2018, exposing the employer did not ensure that employees were protected from falls. Employees were working on the roof of a four-story commercial building installing insulation roof panels near the perimeter of the roof without a fall protection system. This condition exposed employees to an approximately 40 foot fall hazard.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)MMI, LLC at 825 Eglin Street, Rapid City, SD 57003: On or about and at times prior to August 16, 2018, the exposing employer did not ensure that employees were trained to recognize hazards associated with falls and proper usage of fall protection systems. This condition exposed employees to a 40-foot fall hazard.

29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail:    (a)MMI, LLC at 825 Eglin Street, Rapid City, SD 57003: On or about and at times prior to August 16, 2018, the exposing employer did not ensure that the stairways leading from the main floor to the second, third, and fourth floors were equipped with a handrail. The stairway had approximately 10 risers to each landing/floor. This condition exposed employees to fall hazards while using the stairway.
