On or about August 23, 2018, at the construction site located at Building #3, 2581 Walcutt Road, Hilliard, Ohio, the employer failed to instruct each employee in the avoidance of unsafe conditions while performing construction activities.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a.   On or about August 23, 2018, at the construction site located at Building #3, 2581 Walcutt Road, Hilliard, Ohio, employees were performing framing work on the second story floor level of a two story residential apartment building at approximately 10 feet in height with no fall protection, thereby exposing the employees to a fall hazard.  b.   On or about August 23, 2018, at the construction site located at Building #3, 2581 Walcutt Road, Hilliard, Ohio, an employee was performing framing while standing on top of second floor walls of a two story residential apartment building at approximately 10 feet in height with no fall protection, thereby exposing the employees to a fall hazard.
