29 CFR 1926.1053(b)(16): 29 CFR 1926.1053(b)(16): Portable ladder(s) with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired: (a) The portable ladder being used to access the second floor deck was defective (bent rung) and was not tagged " Do Not Use " or removed from service.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) Employees conducting floor decking operations from a 2nd floor deck of Building 1A, were not adequately protected from falls to the lower level. This exposed employees to a fall hazard. (b) Employees conducting carpentry operations from the first floor level of Building 1A, were not adequately protected from falls to the lower level. This exposed employees to a fall hazard. The Roger Mendoza dba Popeye Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFT 1926.501(b)(13), which was contained in OSHA inspection number 1287276, citation number 1, item number 1 and was affirmed as a final order on April 2, 2018, with respect to a workplace located at 700 S. 8th St., Sheboygan, WI 53081.
