29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years. Located along the front garage area of the residential new home under construction an observed powered industrial truck operator employee elevated and worked from unsecured plywood placed on the forks of a Mustang 634 forklift without a safety platform or other fall protection exposed to fall potentials in excess of 14 feet who had not had an operator performance evaluation conducted by the employer or equivalent at least once every three years since initially trained ten years prior August 21, 2018.
