29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On August 24, 2018 at 2560 Miamisburg-Centerville Road, Dayton, a commercial building under renovation, an employee on a wood deck nailing paper to the wall for stone work was exposed to a 12 ft. fall hazard without utilizing any fall protection.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. On August 24, 2018, at 2560 Miamisburg-Centerville Road, Dayton, a commercial building under renovation, a fall protection system had not been provided and installed on or around the wood deck prior to allowing an employee to work on the wood deck nailing black paper on the wall of the building in preparation for stone work.
