Employees were exposed to serious struck by injuries from potential cave in, in that there was water accumulating in the excavation employees were working in.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary: At a jobsite located at the intersection of Lawn and Winn Rd in Kansas City, MO. An employee working in an 6 foot deep excavation was exposed to serious struck by and or engulfment hazard, in that the spoils piles had not been placed at least two feet from the edge of the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): At a jobsite located at the intersection of Lawn and Winn Rd in Kansas City, MO: Employees engaged in work in an excavation were exposed to a struck by hazard. The employer did not provide or require the use of benching, sloping, shoring or other means to ensure that employees working in the excavation were protected from excavation wall failure. The trench was approximately 6 feet in depth. Blue Nile Contractors was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1) which was contained in OSHA inspection number 1109361, citation number 1, item number 2 and was affirmed as a final order on 1/6/2016, with respect to a workplace located at 8529 N Highland, Kansas City, MO.
