OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about August 24, 2018, employees were exposed to crushing and struck by hazards while painting the underside of an elevated dumpster that was 289 inches long by 96 inches wide and weighed approximately 12,262 pounds. Employees were exposed to the hazards due to: A) The load was not evenly distributed, properly supported or positioned on each of the lifting swing arms, nor the load centered between the two hydraulic powered two-post, frame engaging, drive over, surface mounted automotive lifts installed in the paint booth. The load was positioned between the surface mounted automotive lifts and supported using only two lifting swing arms from each of the automotive lifts; and B) The employee operators had not been instructed in the safe use and operation of the lifts using the manufacturer-provided instructions, warning labels and the applicable industry publications and guidelines. Without the proper instruction the employee operators were unable to ensure the loads were positioned in such a way as to ensure the center of gravity of the load was balanced and the weight of the load fully engaged on all of the lift swing arms.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On and before August 24, 2018, employees were exposed to crushing and struck by hazards while painting various sizes of elevated dumpsters using hydraulic powered two-post, frame engaging, drive over, surface mounted automotive lifts installed in the paint booth. Employees were exposed to the hazards due to: A) The lift capacity was not indicated on the automotive lifts, nor was it known by the employer and employee operators resulting in potential overloading of the automotive lifts used to elevate loads weighing as much as 12,262 pounds; and B) The automotive lifts were not inspected, repaired, and maintained to ensure reliability and allow the continued safe operation of the lifts.
