The employer failed to provide an employee with a safe means of egress from the excavation that was greater than 25 feet in length.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:  At a residential construction site located at 12910 Foxglove Ct, Platte City, MO: Employees were exposed to caught-by  and struck-by hazards. The employer failed to protect employees from accumulation of water inside the excavation after a period of heavy rainfall. Water was seeping into the excavation from the surrounding soil and was not removed by any safe means from the work area.

An employee were observed working in a trench with excavated materials adjacent to the edge of the excavation. In addition the excavator was being operated while the employee was located inside the excavation.

The employer failed to protect employees from recognized hazards associated with the absence of protective systems in combination of  compromised soil conditions and the accumulation of material along the edge of the excavation. The excavation was not examined by a component person who understood how to properly evaluate the soil conditions.
