29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. On or about August 24, 2018, the employer failed to develop and implement safety and health programs which included the need for frequent and regular inspections of the job site (including materials, equipment and personal protective equipment needs) to help ensure protection of employees from recognized hazards as well as compliance with established Occupational Safety and Health Standards.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: On or about August 24, 2018, the employer failed to protect an employee from a fall from height hazard of approximately 14 feet by ensuring the portable ladders that were being used extended the upper landing surface by at least 3 feet. The ladders placed for access were at 1.5 feet and 2 feet above the upper landing surface.
