OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    a)  Worksite - On or about August 24, 2018, an employee was being lifted by a forklift to an elevated working height without utilizing an appropriately designed personnel lifting platform.       Among other methods, a feasible and acceptable means to abate these hazards is to follow ITSDF B56.1-2005 entitled, "Safety Standard for Low Lift and High Lift Trucks," Section 4.17 Elevating Personnel, which states, "Only operator-up high lift trucks have been designed to lift personnel. If a work platform is used on trucks designed and intended for handling materials, the requirements of paragraphs 4.17.2 and 4.17.3 shall be met for the protection of personnel. Platform design must also meet the requirements of paragraph 7.37.3 to ensure the necessary moving part protection."
