29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified per 29 CFR 1910.178(l): (a) Triton Enterprises Inc, dba Triton Roofing & Solar, at 425 Wood Road, Snowmass Village, CO: On and preceding 8/28/18, the employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified per 29 CFR 1910.178(l). An employee operated a Caterpillar model TL1055C rough terrain powered industrial truck to raise material to the roof of a multi-story structure and to lower a dumpster containing debris from roofing work. The employer did not ensure that the operator had successfully completed training and evaluation. This condition exposed the employee and other workers to struck-by hazards.
