29 CFR 1910.107(b)(1): The spray booth was not substantially constructed of steel, securely and rigidly supported, or of concrete or masonry:  a) In the facility, on or about July 15, 2018 - The employer did not ensure that the spray booth was substantially constructed of steel, concrete, masonry, or other noncombustible material.  Employees were applying flammables such as, but not limited to SHER-KEM Metal Finishing Enamel and Xylene in a booth framed with 2-inch by 4-inch wood and covered with plastic.

29 CFR 1910.107(g)(5): Where solvents with flash points of less than 100 degrees F were used for the cleaning of spray nozzle and auxiliary equipment, cleaning was not conducted inside spray booths and ventilation equipment operated during cleaning:   a) In the facility, on or about July 15, 2018 - The employer did not ensure that the cleaning of spray nozzle and auxiliary equipment was conducted inside a spray booth with the ventilating equipment operated during cleaning.  Employees frequently cleaned spray finishing equipment on the shop floor using solvents with a flashpoint of 80.6-degrees Fahrenheit such as Xylene.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) In the facility, on or about July 15, 2018 - the employer did not ensure that employees required to wear tight-fitting respirators were provided a medical evaluation to determine their ability to use a respirator in the workplace.  Two employees designated as a Supervisor and Shop Manager were utilizing a full-facepiece respirator for spray finishing and were not medically evaluated prior to the use of the respirator.
