29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section. (a) JKC Inc. dba Steamboat Asphalt / Parking Maintenance dba Osmun Inc., at 615 Wickes Ave., Bldg B, Craig, Colorado: On and before August 30, 2018, the exposing employer did not ensure that a scaffold platform attached to the forks of a rough terrain forklift which was used to raise and lower personnel to and from the roof was designed by a qualified person. The JLG Model # G9-43A operator's manual states to use only an approved work platform for lifting and lowering personnel. In addition, the manufactured cage did not have mid rails installed. This condition exposed employees to a fall hazard of approximately 15 feet.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use. (a) JKC Inc. dba Steamboat Asphalt / Parking Maintenance dba Osmun Inc., at 615 Wickes Ave., Bldg B, Craig, Colorado: On and before August 30, 2018, the employer used a JLG Model # G9-43A all terrain forklift to elevate an employee. While installing new windows to the third floor of the apartment buildings, the employee stood on and worked from a job made metal platform that was welded to the forks of the all terrain forklift. This exposed the employee to a all hazard of approximately 15 feet.
