29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) The employer did not ensure a competent person was on site who was trained in, but not limited to, soil examination and analysis, need and usage of protective system and potential for cave-ins. Employees were working in an excavation and the company did not conduct a soil analysis or have a competent person onsite.
