OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, in that employees were exposed to struck by hazards: On or about 08/29/18 and at times prior thereto employees walked, worked, and operated forklifts in proximity of storage racks inside the warehouse, and were exposed to be struck-by and/or crushed by metal racks and stored materials in the event of a collapse of the free standing, unanchored metallic storage racks The owner did not maintain the structural integrity of the installed rack system by assuring proper operational, housekeeping, and maintenance procedures in order to correct deficiencies including (but not limited to) the following: a) Warehouse - The rack system was free-standing and was not anchored to the floor. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

The platform measured 48 in. x 96 in., and extended 56 in. beyond the length of the forks. Or in the alternative: 29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Facility - On or about 08/29/18 and at times prior thereto employees operated the Toyota cherry picker and climbed on top of a makeshift wood platform which was mounted loose on top of the forks. The platform measured 48 in. x 96 in., and extended 56 in. beyond the length of the forks.
