29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.  Refrigerator Scrap Room:  1) The brake lights of the Yale Fork Truck are inoperable. The lens cover of one of the brake lights is damaged.  2) The rear tires of the Yale Fork Truck have excessive wear.  3) The fork assembly of the Yale Fork Truck is chained to the part behind the forks due to the forks being unstable
