29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On or about August 29th, 2018 and at times prior, for employees exposed to cave in hazards while replacing a waterline in an excavation up to nine feet deep without adequate protective systems on place in the vicinity of 811 Fourth Avenue in Williston, North Dakota. (b) On or about August 29th, 2018 and at times prior, for employees exposed to cave in hazards while replacing a waterline in an excavation up to seven feet deep without adequate protective systems in place in the vicinity of 816 Fourth Avenue in Williston, North Dakota. (c) On or about August 29th, 2018 and at times prior, for employees exposed to cave in hazards while replacing a waterline in an excavation up to seven feet deep without adequate protective systems in place in the vicinity of 815 Fourth Avenue in Williston, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1157679, Citation 1, Item 1a, and was affirmed as a final order on October 25th, 2016, with respect to a workplace located at or near the vicinity of Fifth Avenue & Sixth Street in Washburn, North Dakota.
