OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: a) On or about September 5, 2018, and times prior to, at Arnold Oil Company in Midland, Texas, the facility storage racks were not anchored which exposed employees to hazards associated with getting struck-by falling products and also cross members and racks themselves. b) On or about September 5, 2018, and times prior to, at Arnold Oil Company in Midland, Texas, the facility storage racks were not marked with the structural rack load capacity which exposed employees to hazards associated with getting struck-by falling products and also the cross members and racks themselves.
