(a) Mountain Top Homes at 4273 Spruce Way in Vail CO 81657:  On August 31, 2018, the exposing employer did not report the hospitalization of an injured worker.  An employee sustained multiple severe injuries as a result of trench cave-in which occurred on August 31, 2018 at approximately 3:00 pm.  The employer reported the incident on September 4th, 2018 to OSHA phone hotline.

(a) Mountain Top Homes at 4273 Spruce Way in Vail CO 81657:  On or before August 31, 2018, the employer did not ensure that each employee on the jobsite was trained on safety and health hazards in trenching operations. Two employees were installing water lines in trenches greater than 6 feet deep without any safety training regarding the hazards associated with this work.  This condition exposed employees to cave-in and struck-by hazards.

Employees were installing a water line in a trench more than 6 feet deep, working under an undermined section of pavement.  This condition exposed employees to cave-in and struck-by hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems.    (a) Mountain Top Homes at 4273 Spruce Way in Vail CO 81657:  On or before August 31, 2018, the employer did not ensure that daily inspections of the trench were conducted by a competent person.  The employer failed to identify hazardous conditions that would require the use of a trench box or other means of shoring.  These hazardous conditions included but are not limited to:  Type C soil, pavement over hang, and potential traffic disturbances.  Employees were installing a water line in a trench more than 6 feet deep without any means of shoring in Type C soil.  This condition exposed employees to cave-in and struck-by hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).    (a) Mountain Top Homes at 4273 Spruce Way in Vail CO 81657:  On or before August 31, 2018, the exposing employer did not  ensure that employees working inside a trench with vertical walls were protected from cave-in, in that employees used a shovel to locate utility lines without using a protective system.  The trench collapsed and caused severe injuries to at least one employee who suffered broken pelvis, broken ribs, and head injuries.  The trench was approximately 6 feet in depth, 4 feet in width, and at least 20 feet in length.  This condition exposed employees to a crushing hazard by excavation wall cave-in.

(a) Mountain Top Homes at 4273 Spruce Way in Vail CO 81657:  On August 31, 2018, the employer provided an A-frame ladder as a means of egress from a trench.  The A-frame ladder was closed and leaning up against the unprotected trench wall.  A-frame ladders are not a safe means of egress for a trench per 29 CFR 1926.651 (c) (2) and the ladder was not being used as intended for A-frame design.  This condition exposed employees to cave-in and struck-by hazards.
