29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift: Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On or about September 5, 2018, employees were exposed to a fall of approximately 12 feet while installing flashing on a commercial building located at 24391 Gibson Street, Warren MI, 48089. The employer permitted employees to work from an articulating lift without using a personal fall arrest system. The Designers Mirror & Glass Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.453(b)(2)(v), which was contained in OSHA inspection number 1269872 citation number 1, item number 1 and was affirmed as a final order on November 9, 2017 with respect to a workplace located at 3737 Union Cheecktowaga New York 14225.
