Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did  not furnish to each of his employees employment and a place of employment which are free from recognized struck-by  and crushed by hazards that are causing or likely to cause death or serious physical harm to their employees:    (a) On or about September 6, 2018 at bay 2 of the facility located at 143B Murphy Road, an employee operating a 2004 Peterbilt Truck,  with an attached JMH 70 yard dump trailer,  was attempting to empty the trailer of its debris when the truck and attached trailer  tipped over when the loaded debris did not exit the trailer when the trailer was raised. This action created an unstable condition. The operator was not wearing a seat belt and was ejected from the operators cab.
