OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushed or caught under hazards while operating a powered industrial truck: a) On or about 09/05/2018 - Shop, employees were observed operating powered industrial trucks in a congested shop removing large steel boxes without wearing a seatbelt. b) On or about 09/05/2018 - Outside the shop, employees were observed operating powered industrial trucks to move finished products for shipment without wearing a seatbelt.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) On or about 09/05/2018 - Fabrication shop, a First vertical milling machine (Model #LC-185VS, Serial # 4070922) was being operated with exposed rotating parts. b) On or about 09/05/2018 - Fabrication shop, a drill press was being used with exposed rotating parts. c) On or about 09/05/2018 - Cut off area, a large Hyd-Mech horizontal band saw was being operated with the unused portion of the blade unguarded. d) On or about 09/05/2018 - Cut off area, a small Hyd-Mech horizontal band saw was being operated with the unused portion of the blade unguarded.
