29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline. On or about September 6, 2018, at the above addressed jobsite, employees were working in an excavation in which water accumulated from groundwater at the base of the trench. Employees' mobility was severely limited while working in the trench due to submerged soil. The employer failed to remove accumulated water thus exposing employees to an entrapment hazard due to lack of mobility within the excavation. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about September 6, 2018, at the above addressed jobsite, employees were working in a trench that was 5-7.7 feet in depth installing a water line. The trench was not provided with cave in protection, thereby exposing the employees to cave-in hazards. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
