29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. a) Upper Roof - Employees conducting roofing operations on a flat roof were not protected from an approximate 27 foot fall hazard to the ground below, on or about September 6, 2018. b) Lower Roof - Employees conducting roofing operations on a flat roof were not protected from a 14 foot - 2 inch fall hazard to the ground below, on or about September 6, 2018. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records. ------------------------------------------------------------------------------------------------------------------------------------ Due to Informal Settlement Agreement of 10/23/18, Instance (b) has been deleted.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Roof - Employees used a portable extension ladder to gain access to an upper roof and the ladder's side rails extended approximately 18 inches above the landing surface exposing employees to fall hazards, on or about September 6, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
