29 CFR 1910.29(b)(13): When guardrail systems are used around holes that serve as points of access (such as ladderways), the guardrail system opening did not meet the requirements (b)(13)(i) or (b)(13)(ii) of this section.    On or about 4 September 2018, and at times prior thereto, three rooftop evaporative condensers had fixed ladders where the ladderway opening was unguarded, exposing employees to a fall hazard of approximately 40 feet to the pavement below.

29 CFR 1910.119(f)(1)(iii)(B): The employer failed to ensure that the Process Safety Management Standard Operating Procedures included safety and health consideration precautions necessary to prevent exposure, including engineering controls, administrative controls, and personal protective equipment.    On or about 4 September 2018, and at times prior thereto, the employer did not ensure the King Valve for the High Pressure Receiver was readily accessible in order to implement the shutdown procedure in the event of an emergency. The valve was identified by signage but is located on top of the Receiver with no ladder or platform to reach the valve.
