29 CFR 1910.29(b)(13): When guardrail systems are used around holes that serve as points of access (such as ladderways), the guardrail system opening did not meet the requirements (b)(13)(i) or (b)(13)(ii) of this section. On or about 4 September 2018, and at times prior thereto, three rooftop evaporative condensers had fixed ladders where the ladderway opening was unguarded, exposing employees to a fall hazard of approximately 40 feet to the pavement below.

On or about 4 September 2018, and at times prior thereto, the employer did not ensure the King Valve for the High Pressure Receiver was readily accessible in order to implement the shutdown procedure in the event of an emergency. The valve was identified by signage but is located on top of the Receiver with no ladder or platform to reach the valve.
