29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing hazards): When changes at the worksite required different equipment for safe work, an inspection was not conducted by a competent person to identify the equipment needed to reach the camera wiring on the perimeter light pole observed during the inspection. The scissors lift that had been used to install light pole wiring was unable to be positioned in order for the employee to reach the wiring installation. The employee had stepped onto the midrail of the scissors lift in order to reach the wiring. A co-worker was standing on the ground handing materials to the employee on the lift. Work was performed at a QT convenience store construction site on September 10, 2019 at 850 McNutt St., Herculaneum, MO.

29 CFR 1926.454(a)(3): The employer did not train each employee who performs work on a scaffold, by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards, including the proper use of the scaffold and the proper handling of materials on the scaffold: Site specific training had not been provided in order to identify the equipment needed in order to perform work safely and to identify that a scissors lift was not going to be able to reach the camera lighting on all poles to be wired. The scissors lift that had been used to install camera wiring on other poles was unable to be positioned in order for the employee to reach the wiring installation observed during the inspection. The employee had stepped onto the midrail of the scissors lift in order to reach the wiring. A co-worker was standing on the ground handing materials to the employee on the lift.
