29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a) GPS Coordinates 44.087856-111.279521:  On September 4, 2018, and at times prior thereto, the employer did not instruct employees in methods to control and/or eliminate potential cave-in hazards prior to working in trenches and excavations.   Employees were working to install an irrigation pipeline in a trench at a approximated depths ranging from 7.0 to 10 feet.  Abatement certification AND documentation are required for this item.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift.  a) GPS Coordinates 44.087856-111.279521:  On September 4, 2018, and at times prior thereto, for the trench excavated,  the employer did not ensure a "competent person" inspected trenches and excavations prior to the start of work and as needed throughout the shift.  Employees were working to install a irrigation pipeline in an excavation at a depth ranging from approximately 4.0 to 10 feet.  Inspections were not completed for the potential cave-in hazards on the site.   Abatement certification AND documentation are required for this item.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.    a) GPS Coordinates 44.087856-111.279521:  On September 4, 2018, and at times prior thereto, the employer did not ensure the use of an appropriate ladder or other safe means of egress while employees were working to install an irrigation line in a trench at a depth ranging from 7.0-10 feet.  Employees jumped in as ingress and/or climbed out from the walls of the trench as ingress/egress from the work location.       Abatement certification AND documentation are required for this item.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) GPS Coordinates 44.087856-111.279521:  On September 4, 2018, and at times prior thereto, excavated material (spoils) were not at least 2 feet back from the excavation along the north and south side of the trench.  A 8-10' deep (wet) spoil pile weight would be approximately 17,800-33,000 pounds, exposing employees to crushing hazards and/or asphyxiation.     Abatement certification and documentation ARE required for this item.
