OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a fall hazards: On or about 9/7/2018, at 9465 Miami Valley Road, Fort Valley, GA: Employee observed working on the guardrail system of the rough terrain scissor lift welding metal material at heights up to or above 10 feet from ground level. The employer failed to ensure the guardrail system was capable of supporting the weight and the employee worked inside the rough terrain scissor lift work platform or provided a personal fall arrest system as fall protection.
