OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees due to falls while working from a scissor lift. On September 11, 2018, two employees were standing/sitting on the guardrails of a Genie GS1930 scissor lift. The employees are exposed to a fall up to 16 feet.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): Employees were exposed to being struck by a Genie Rough Terrain Forklift which was used to lift structural steel units during the construction of a system engineered building. The employees did not successfully complete the training and evaluation specified by paragraph (l) of 29 CFR 1910.178.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: Four employees were exposed to cuts and bruise due to installing metal structural units overhead while using a scissor lift. The employees were not protected by the use of protective helmets (hard hats).
