29 CFR 1926.451(f)(7): The employer did not ensure that scaffolds were erected, moved, dismantled, or altered only under the supervision and direction of a competent and qualified person: a) The employer did not ensure the scaffold was dismantled under the direction of a competent person. The employer did not use a hoist to remove scaffold components, the components were dropped to employees below. An employee was hit on the back by a frame when the employee higher up did not catch it. Location: 211 McGuinness Blvd, Brooklyn NY On or about 8/9/2018 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects. For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall. a) When dismantling the 50 ft tall scaffold the employees worked directly below each other when scaffold components were dropped; an employee was hit on the back.
