OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of being thrown from, pinned under, or crushed by a powered industrial truck (forklift) when operating the equipment without a seat belt:    a) On or about 9/12/18 or prior thereto:   employees were not wearing a seatbelt while operating a propane powered, Sellick, TMF-55, S/N 559540255320, powered industrial truck.  b)On or about 9/12/18 or prior thereto:   employees were not wearing a seatbelt while operating a propane powered, Yale, GLP040AFNUAV096, S/N B810N01812Y,  powered industrial truck.  c) On or about 9/12/18 or prior thereto:  employees were not wearing a seatbelt while operating a propane powered, Hyster, 55, H177B04349V,  powered industrial truck.   Note:  Abatement certification is required for this item.

29 CFR 1910.136(a):  The employer did not ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, such as a static-discharge or electric-shock hazard, that remains after the employer takes other necessary protective measures.   a) On or about October 10, 2018, in the Metal Recycling Yard:   The employer did not ensure that employees used adequate foot protection to protect from sparks and molten metal during oxygen/acetylene cutting of a truck frame.  NOTE:  Abatement certification is required for this item.

Abatement certification for this item is not required.
