29 CFR 1910.38(c)(2): The emergency action plan did not include the minimum elements of an emergency action plan listed in (c)(1) through (6) of this standard.    On or about 12 September 2018, and at times prior thereto, workers at the Smiley Hub were exposed to an explosive vapor cloud while mustered at the Assembly Point located just outside the front gate. The Employer had posted a sign indicating the location was the Evacuation Assembly Area, San Antonio Division, EOG Resources. The sign was contradictory to the written Emergency Action Plan (EAP), both in the Control Room and within the Plan.

29 CFR 1910.119(d)(3)(i)(B): The employer did not include all equipment that was part of the process on piping and instrument diagrams.    On or about 12 September 2018, and at times prior thereto, piping and instrumentation diagrams did not reflect actual conditions in the facility.  a) H2S Detector: AIT 7401 located at H2S Station #13 was not reflected on P&ID SMLY-PID-1701, both in the initial company submission on 12 September 2018, and again on 14 February 2019.  b) MOCR SMY2016-063: P&ID SMLY-PID-1101 indicated this MOCR as a redline change as of 05/06/16 but had not been implemented in the field. The company was awaiting a plant shutdown in order to implement the physical change.

29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices.     On or about 12 September 2018, and at times prior thereto, equipment and piping involved in the process was not labeled or had illegible markings as per 1989 ASME Boiler and Pressure Vessel Code, Section VIII, Division 1, UG-119(c)(2), NFPA 704, and ASME/ASAA13-1928, exposing workers within the processing area to explosion effects from overpressure, toxic atmosphere, fire and projectile hazards.   a) The nameplate on pressure vessel V-1405 (Flash Separator) was painted over, concealing the operating information for the vessel.   b) The piping system within the facility did not indicate the hazard, contents, flow direction, or chemical state of gas or liquid.

29 CFR 1910.147(c)(5)(ii)(D): Lock-out devices and tag-out devices did not indicate the identity of the employee applying the device(s).    On or about 12 September 2018, and at times prior thereto, a lock and tag were utilized on HOA P-3605, Hands-Off Auto Switch for Pump 3605, without any identification as to who applied the lock and tag, when it was applied, for what purpose, or any remarks. Later, it was determined the tag and lock were meant to remind personnel to refill the pump with oil prior to operating the pump.
