29 CFR 1910.95(i)(2)(i): The employer did not ensure that hearing protectors are worn by an employee who is required by 29 CFR 1910.95(b)(1) to wear personal protective equipment:  The employer did not ensure that hearing protectors were worn by employees, who worked in the pallet remanufacturing area, and were exposed to noise that had exceeded an 8-hour TWA of 85 dBA, based on an 80 dB threshold:   (a) A pallet remanufacturing employee was exposed to continuous noise levels at 109.3% of the permissible 8-hour time weighted average (TWA) . The equivalent level of 109.3% is approximately 90.6 dBA. Sampling was performed for 423 minutes during one shift. Zero exposure was assumed for the 57 minutes not sampled.
