29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  a. On or about September 12, 2018, at the above addressed jobsite, employees performing painting operations from a JLG, model number 450AJ, telescopic boom aerial lift, approximately fourteen (14) feet above the ground, were not utilizing personal fall arrest systems, thereby exposing employees to fall hazards.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  a. On or about September 12, 2018, at the above addressed jobsite, employees conducting painting operations from a JLG, model number 450AJ, telescopic boom aerial lift were not trained to recognize the hazards associated with the use of the equipment. The employees were thereby exposed to the hazards associated with falls.
