29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  A) Fredy Soto on or about September 13, 2018 at the address of 3540 Secor Road, Toledo, OH: The employer failed to ensure that an employee operating a fork truck was adequately trained. Employees working near or around untrained operators were exposed to struck-by hazards while elevating scaffolding equipment to the top platform of the scaffold during erection operations.

A) Fredy Soto on or about September 13, 2018, at the address of 3540 Secor Road, Toledo OH: The employer did not ensure the foreman and employees were trained in scaffold erection and dismantling prior to erecting supported scaffolding onsite. Employees performing this work in this condition were exposed to fall of 52.8 ft to the ground below without the benefit of competent supervision.

A) Fredy Soto on or about September 13, 2018 at the address of 3540 Secor Road, Toledo, OH: The employer failed to provide a competent person to determine the feasibility, selection, and use of fall protection, while employees were engaged in erecting a supported scaffold. Employees were exposed to 52.8 foot falls to the ground below.

A) Fredy Soto on or about September 13, 2018 at the address of 3540 Secor Road, Toledo, OH: The employer did not ensure employees working from a walk through scaffold installing felt to the structures exterior wall was trained in the recognition of hazards associated with this type of scaffold. Fall hazards went unrecognized by the employee and foreman, exposing the employee to a 52.8 foot fall to the ground below.

A) Fredy Soto on or about September 13, 2018 at the address of 3540 Secor Road, Toledo, OH: The employer failed to ensure guardrail were installed on all open ends of the scaffolding before releasing the scaffold for an employee to felt the structures exterior wall. The employee felting the structure wall was exposed to a fall of 52.8 feet to the ground below.
