29 CFR 1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face:  a) Jobsite: On or about September 13, 2018 and at times prior thereto an eight foot trench box was not high enough to provide the necessary protection for employees working within the trench box.  Soil from an excavated side wall cracked and came over the top and into the trench box. The trench was between 9 and a half to 10 and a half feet deep with type C soil.    b) Jobsite: On or about September 13, 2018 and at times prior thereto employees working within an eight foot trench box were not protected on the end from the backfill material and soil from a collapsing side wall.  A chunk of soil rolled into the end of the trench box, striking an employee.  The trench was between 9 and a half to 10 and a half feet deep with type C soil.    Note) Certification of corrective action is required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a) Jobsite: On or about September 13, 2018 and at times prior thereto an eight foot trench box was used in a trench that was approximately 9 1/2 to 10 1/2 feet deep.  The soil was type C.     Note) Certification of corrective action is required for this item.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  a) Jobsite: On or about September 13, 2018 and at times prior thereto the competent person on site did not perform a thorough evaluation of the soil conditions to ensure the protective system(s) used provided full protection for employees.  Employees working within an eight foot trench box were exposed to unstable soil conditions both above and at the far end of the trench box.      Note) Certification of corrective action is required for this item.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  a) Jobsite:  On or about September 13, 2018 and at times prior thereto the designated competent person allowed employees to work in a 9 1/2 to 10 1/2 foot deep trench.  The combination of a single 8 foot trench box with no end plate in place and benching of type C soil, exposed employees to the hazard of collapsing walls with soil entering the  box from the top and unprotected end.    Note) Certification of corrective action is required for this item.
