29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e): a. On or about September 14, 2018, at the above addressed jobsite, an employee conducting painting operations from a Genie Z-45/25 aerial lift was not wearing a body belt or full body harness. The employee was thereby exposed to the hazards associated with a fall of approximately 25 feet.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the hazards assocated with falls from the scaffold: a. On or about September 14, 2018, at the above addressed jobsite, an employee conducting painting operations from an aerial lift was not provided training on how to minimize fall hazards, thereby exposing the employee to hazards associated with falls.
