29 CFR 1926.454(c): When the employer had reason to believe that an employee lacked the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, the employer did not retrain each such employee so that the requisite proficiency was regained:      a) Job site, 4000 Weatherburn Drive, Valencia, PA: On or about September 14, 2018, during construction activities, the employer did not ensure that employees working on a scaffold were retrained where safety concerns arose regarding it's use. Deficiencies noted during the inspection included, but were not limited to, failing to ensure scaffold baseplates sat level on mudsills, working on a scaffold while still erecting it and permitting employees to climb the ends of walk through frame scaffold to get up/down from the scaffold.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:      a) Job site, 4000 Weatherburn Drive, Valencia, PA: On or about September 14, 2018, during construction activities, the employer did not ensure that an employee on a roof loading wood and brick stack racks onto the roof utilized appropriate fall protection systems/devices where exposed to fall hazards of up to approximately 10 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards that enabled the employee to recognize the hazards of falling and that trained each employee in the procedures to be followed in order to minimize these hazards:      a) Job site, 4000 Weatherburn Drive, Valencia, PA: On or about September 14, 2018, during construction activities, the employer did not ensure that an employee was provided fall protection training prior to working on a roof to load wood and brick stack racks, where fall hazards of up to approximately 10 feet existed.
