29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) Shop - On or about 09/14/18 and at times prior thereto employees worked in mechanical repairs, brake service, oil change, and tire installation, and came in contact with chemicals including (but not limited to) brake fluid, compressed oxygen/acetylene for gas welding, compressed argon, hydraulic fluid, motor oil, transmission fluid, and throttle plate cleaner. The employer did not train employees in relation to the Hazard Communication Program and the "Right to Know". In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification that identified the workplace evaluated, the person certifying that the evaluation had been performed, the date(s) of the hazard assessment, and, which identified the document as a certification of the hazard assessment: a) Shop - On or about 09/14/18 and at times prior thereto employees came in contact with automotive chemicals, and performed mechanical repairs, lubrication, brake service, and tire installation. The employer did not certify that a hazard assessment had been performed in order to determine whether personal protective equipment was required. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
