29 CFR 1910.212(a)(3)(ii): Points of operation of machinery were not guarded to prevent employees from having any part of their body in the danger zones during operating cycles: (a) Fabrication Shop - Employees used a foot pedal to operate the LVD Strippit PPEC-220/42 press brake to form parts some of which required the employees to get to within 4 inches of the point of operation, and the press brake did not have point of operation guarding in accordance with the OSHA standard, exposing employees to point of operation hazards, such as caught-in and struck-by, on or about September 10, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.212(a)(3)(iii): Special hand tools for placing and removing material were used in lieu of other guarding required by this section rather than used to supplement protection: (a) Fabrication Shop - Employees used a foot pedal to operate the LVD Strippit PPEC-220/42 press brake to form parts some of which required the employees to get to within 4 inches of the point of operation, and in lieu of other guarding, employees used hand tools, such as pliers and vice grips to hold parts, exposing employees to point of operation hazards, such as caught-in and struck-by, on or about September 10, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
