29 CFR 1910.219(d)(1): Pulley(s) with part(s) seven feet or less from the floor or work platform were not guarded in accordance with the requirements specified in 29 CFR 1910.219(m) and (o):     (b) Vasquez Ready Mix, LLC, DBA Velocity Ready Mix LLC, 7555 E 41st Ave., Denver, CO 80216: On and before September 18, 2018, the employer did not ensure that the pulley on the drive motor on the batch plant was guarded. The pulley above the bottom end of the end of the aggregate conveyor belt was exposed. The equipment is approximately 6 feet above the ground.  This condition exposed employees to the hazards of ingoing nip points.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  (a) Vasquez Ready Mix, LLC, DBA Velocity Ready Mix LLC, 7555 E 41st Ave., Denver, CO 80216: On and before September 18, 2018, the employer did not provide employees who were required to wear tight fitting respirators in dusty area with fit tests prior to their use of said respirators. This condition exposes employee to hazards associated with respirable silica, including but not limited to silicosis.

29 CFR 1910.1053(d)(3)(i): The employer did not perform initial monitoring to assess the 8-hour TWA exposure for each employee on the basis of one or more personal breathing zone air samples that reflect the exposures of employees on each shift, for each job classification, in each work area:  (a) Vasquez Ready Mix, LLC, DBA Velocity Ready Mix LLC, 7555 E 41st Ave., Denver, CO 80216: On and before September 18, 2018, the employer did not conduct initial monitoring for employees who work in the yard, or batch plant. These employees clean the dispensing area, as well as dispense material into concrete mixing trucks. This condition exposed employees to respiratory hazards from exposure to respirable silica.

29 CFR 1910.1053(j)(3)(i): The employer did ensure that each employee covered by this section could demonstrate knowledge and understanding of  the health hazards associated with exposure to respirable crystalline silica; specific tasks in the workplace that could result in exposure to respirable crystalline silica; specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica; the contents of this section; and the purpose and a description of the medical surveillance program required by paragraph (i) of this section:  (a) Vasquez Ready Mix, LLC, DBA Velocity Ready Mix LLC, 7555 E 41st Ave., Denver, CO 80216: On and before September 18, 2018, the employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of  the health hazards associated with exposure to respirable crystalline silica, including but not limited to immune system and kidney effects. This condition potentially exposed employees to the hazards of respirable crystalline silica.
