29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about September 14, 2018 employees are exposed to a fall hazard while performing shingle tear off and replacement on an apartment building. The employees are working from the roof of the building at 1384 Timber Trail, building 5, Akron, OH. The fall height from the roof to the ground below was measured as 25 feet. The roof has a pitch of 7/12. Anchor points and personal fall arrest systems were on site at the time. Employees were observed both not wearing harnesses, or not tied off to the system. b) On or about September 14, 2018 an employee is exposed to a fall hazard while performing shingle tear off and replacement on an apartment building. The employee is working from the roof of the building at 1384 Timber Trail, building 5, Akron, OH. The fall height from the roof to the ground below was measured as 12-15 feet. The portion of this roof is flat.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: On or about October 22, 2018 employees exposed to fall hazards while performing roof work have not received training in recognition of fall hazards and fall protection procedures. Employees are working from a 7/12 pitch roof approximately 25 feet from the level below without having received training. .
