29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) For employees doing roof work at the commercial building on or about September 19, 2018. The extension ladder side rails were extended approximately 6 inches above the upper landing surface. Employees were exposed to a fall height of approximately 13 feet.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) For employees working at the site on or about September 19, 2018. Employees were installing roofing material on a 6:12 pitch commercial roof without using a fall protection system. Employees were exposed to a fall height of approximately 13 feet. David Marley Roofing Contractor, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1189526, citation number 01, item number 001 and was affirmed as a final order on 5 December 2016, with respect to a workplace located at 2607 Lost Ball Drive, Sebring, Florida 33875.
