29 CFR 1910.178(l)(1)(i):   The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l)  (Construction Reference 1926.602):   a)  660 South Orange Avenue, Livingston, NJ and at the Corporate Offices at 39 Main Street, Second Floor, Newark, NJ.  The foreman operating the Lull Telehandler 1044C-54 Rough Terrain Forklift had not undergone the training and evaluation required to safely operate this equipment.                                      Violation observed on or about 09/05/2018.

Employees who were exposed to falls of up to 26'10" were not provided training on fall hazard recognition and prevention. Employees were exposed to falls of up to 14'5" from the wood framing between the roof and the 3rd floor as workers were climbing on the framing to descend from the roof where a ladder of adequate length should have been provided from the third floor to the roof.                                         Violation observed on or about 09/05/2018.

29 CFR 1926.501(b)(13):   Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   Instance a)  660 South Orange Avenue, 3rd Floor Window Openings, Livingston, NJ.  Employees were exposed to falls of 25' from at least 2 window openings on the 3rd floor of the building as no top rail was present across the opening and the window sill was 25" high which does not provide the required 39" minimum height to protect against falls.                                        Violation observed on or about 09/05/2018.   Instance b)  660 South Orange Avenue, On the Roof, Livingston, NJ.  Employees applying roof sheathing were exposed to falls of 26'10" from the 6 in 12 sloped roof as no methods of fall protection were being uses.                                      Violation observed on or about 09/05/2018.                                                                    V & E Carpentry, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 947340, citation number 1, item number 3, and was affirmed as a final order on 01/15/2014, with respect to a workplace located at 82 Copley Avenue, Teaneck, NJ.
